Question: Discuss about the Liability and Contributory Negligence. Answer: Introduction: In this question, Rebecca and Michelle had gone to attend a performance by Oprah Winfrey. However as a result of a ticketing issue at the box office, the performance got delayed. Therefore, both of them drank wine at a bar while waiting for the performance to start. After the performance, Rebecca knew that Michelle was too drunk but still she decided to ride with Michelle in a car. But after some time, as Michelle was driving to unsafely, Rebecca told her to stop the car as she wanted to get out. But Michelle did not stop the car and after some time the car collided. Rebecca underwent serious injuries in the accident including a broken leg. As a result, now Rebecca wants to know if she can hold Michelle liable and also the effect of the defense of contributory negligence on this case. The law of tort describes contributory negligence as claimants behavior that has contributed in the injury of the claimant because the claimant did not fulfill the standard of care that would have been exercised by any other person under such circumstances for the purpose of avoiding the injury or to avoid the loss that was suffered by the claimant (Mason, 1987). Therefore generally a party facing a claim for negligence uses the defense of contributory negligence. However, the defense of contributory negligence is available only if the defendant is in a position to establish that it was also the fault of the claimant in some way and such fault has also contributed in part, regarding the injury that has been suffered by the claimant (Seddon, 1999). For this purpose, the defendant is also legally required to establish that in case it was just and equitable if the damages payable to the claimant are reduced so that the fault on part of the claimant can be considered (Legg, 1999) Therefore in such cases, the burden is on the defendant to prove that the claimant has also contributed in negligence. An example in this regard can be given of Dann v Hamilton (1939), when the claimant accepted the lift offered by the defendant even while being aware that the defendant was too drunk. The court stated that the defense of volenti non fit injuria will not be applicable in such a case. But the situation would be different if extreme circumstances were presen t, for example if the driver was so down that the drunkenness of the driver was obvious and thus it can be said that an obvious and glaring risk was accepted by the plaintiff (Palmer and Davies, 1980). Owens v Brimmell (1977) also needs to be discussed in this regard. Both the driver and passenger took wine. When they were returning home, the driver lost control and the car hit a lamp post. While deciding the case, the Court of Appeal stated that the passenger has also contributed in negligence because the passenger decided to ride with the defendant even when he was aware of the fact that the driver had consumed alcohol in a large quantity and as a result, it was difficult for the driver to drive safely and properly. The passenger can also be held liable for contributory negligence when the driver was aware of the fact that on the way back, the car will have to be driven by the companion but still the passenger accompanied the driver in excessive drinking. Therefore in such cases, although the defense of volenti non fit injuria is not applicable however the amount of damages awarded to the claimant can be reduced due to the contributory negligence of the claimant. Similarly in Astley v Austrust Limited (1999) , the matter before the court was if the claimant was responsible for contributory negligence because under the contract, it was decided by the defendant to protect the claimant from any loss/damage that may be caused due to the breach. In this case, the court also have to consider if the damages awarded to the plaintiff for the breach of contract can be reduced in view of plaintiffs contributory negligence. The answer given by the High Court to the first problem was in affirmative, the unsettled the second question was negative. However in view of this decision, in most of the states in Australia, amendments have been introduced to reverse the effect of the decision given in this case (Lockhart, 1989). In the present question, Rebecca and Michelle took wine while there were waiting for the show of Oprah Winfrey to start. But while returning back, Rebecca knew that Michelle was too drunk and therefore she cannot drive properly. Still Rebecca accepted to sit with Michelle. Similarly when they were consuming wine, Rebecca knew very well that the car will be driven by Michelle on their way back but she joined her in excessive drinking. But when it became clear that mission could not drive safely, Rebecca wanted to get out. Nonetheless, Michelle kept on driving and the car crashed and Rebecca underwent serious injuries. In this case, under the circumstances, Rebecca has suffered the injuries on account of the negligence of Michelle and at the same time, Michelle had breached the duty of care towards the persons who were riding with her in the car. On the other hand, it can be claimed by Michelle that Rebecca knew very well that Michelle was done when she accepted the ride. Consequently, the risk has been voluntarily assumed by Rebecca. Or in other words, it can be said that Rebecca had also contributed in the negligence due to which she had suffered the injuries. Therefore, Rebecca can sue Michelle for the injuries suffered by our but at the same time Michelle can also claim the defense of contributory negligence due to which the amount of damages awarded to Rebecca may be reduced. In their book, Consider, Dr. Lew Weider and Dr. Ben Gutierrez explain that a worldview is a person’s philosophy of life, a framework a person brings to decision-making, and a filter or lens which a person uses to interpret life and the world around them. Every one person has a worldview. This can be molded by people who surround us from the time we are born to adults. There are multiple groups of people from different cultural and religious backgrounds craving your attention in hopes to share their worldview with you and persuade you. You have to fully desire to understand the teachings of the Bible and be able to spread the gospel starting from the beginning to end. Everything has an origin from which it is created. Having a Christian Worldview I know there is only creator and that is God. I can remember my worldview being shaped as early as three years old. I remember the days of my youth going to church with my family like it was yesterday. From a biblical worldview you can find truth and meaning in the scriptures Genesis 1:1 and Psalm 139:13-26. We know God created the world because our faith and trust start within him. In the Bible, Psalm 8:5 and Genesis 2:15 give identity to mankind. We are strong-willed and viewed as caregivers. We are to nurture all other creatures and the earth around us. In John 17:3 and John 17:20-23 our purpose is the interconnection we have with God. He is the reason we have aligned our life with a Christian framework and one day will be with him in Heaven. In their book, Consider, Dr. Lew Weider and Dr. Ben Gutierrez reveal that Theists answer the questions of morality and ethics primarily through Special Revelation. We have read through scriptures that God loves us all and knows that not one human being is perfect. God knows that only he is righteous and we are given the path to become one with him. Such examples of human nature are found in Psalm 51:5 and Ephesians 2:8-10. The path one human chooses will determine their destiny. In Revelation 21:1-7 and 20:11-15 you will find there is only two ending places in which you will spend eternity. With our faith and our love and commitment we possess as Christians we know our eternity rest within the Heavens above. It is an obligation we have to God to follow his guidance and have comfort in knowing that he knows us better than anyone and one day we will join him. I try hard every day to view the world with an open heart and clean slate. It’s hard not to dwell on events that have happened that was tough, but you have to forgive and forget. I know that I am very blessed. God has given this life and we should open ourselves to love and faith. I see hundreds of people throughout my week and I try to greet them with a smile and a â€Å"Hello†. We need to see the good in people and think of how God would want us to treat each other. If you were having a rough day maybe that one positive experience will uplift you and put you in a better place. Some people live a hard life, some by choice and some by unfortunate circumstances. I’ve always wanted to help heal the people that are sick and need medical attention. It’s been my calling since I was a little girl. I just wanted to help people and I know that God led me down the right path. Currently, I work as a Respiratory Therapist and I come into contact with a lot of ill people. I try my hardest to serve them in a way that I can change their outcome and improve their health. I feel positive and rewarded with the career path I have chosen and I know I am here for a reason. We should take each day as a blessing and strive to be the best person we know how to be. I know these things because my Christian Worldview has put everything into perspective for me. I know what I need to do. I want to help and I want to make a difference in the world. It all starts with believing and God will lead you the rest of the way.

Leonard Peltier Should be Released from Prison Essay -- Argumentative

Leonard Peltier is currently serving time in the Leavenworth federal penitentiary for the shooting deaths of two Federal Bureau of Investigations (FBI) agents. According to FBI documents, at around 11:50 A.M. on June 26th, 1975, agents Jack Color and Ron Williams were supposedly searching for Jimmy Eagle, a thief wanted for stealing a pair of cowboy boots. The agents encroached on the Jumping Bull Compound in Oglala, South Dakota of the Pine Ridge reservation, in two separate vehicles that no one could recognize (Incident). In this area, there were several members of the American Indian Movement (AIM). After the intrusion of the agents, someone-and it is unsure who-fired a shot and a shoot out began. By the end of the shoot out at Pine Ridge, Williams, Color, and one AIM activist, Joe Stuntz Killsright, were dead (Incident). Peltier was one of the AIM members at the Jumping Bull Compound, and ultimately he was charged and convicted on murder charges. There is a great controversy surr ounding the Peltier case. A large contingency of both domestic and international citizens and organizations feel that Peltier has been wrongly convicted, while the Federal Bureau of Investigation and other government authorities here feel as justice was served. Leonard Peltier should be released from prison via Executive Clemency because the evidence that he was convicted under was inconclusive and insufficient to warrant a conviction, the FBI committed many acts of misconduct when pursuing Peltier as fugitive and trying to extradite him from Canada, and his trial was unfair. As an individual committed to social justice, human solidarity, and the liberation of the people, this case is of great interest to me since it is a prime example of the ri... ...ight be lying or covering up something, or even just being far too zealous and unprofessional, is rejected a priori because of the cognitive dissonance it causes in the individual that believes in the FBI. Most people that push for Peltier's guilt simply don't look honestly and objectively (or at least as objectively as possible) at the evidence. Leonard Peltier, currently serving his twenty- fourth year of prison, should be immediately released. As I have shown, there is much reasonable doubt as to whether or not he committed this crime. The hard evidence is minimal to non-existent against him, he was illegally extradited from Canada on perjured affidavits, and his trial was unfair since it was in a hostile setting and the actions of the court seemed biased. While there is no good reason to keep him in prison, there are several good ones for letting him out. Adoption of Islamic Banking Essay

The intention of the study is to identify the benefits which could be drawn in Adoption of Islamic banking by conventional banks and to determine the challenges they are going to face in the adoption. The 60 respondents from various conventional, non-Muslim banks have been chosen through simple random sampling. The result of the survey for the questions regarding the awareness of the local people was considered positive in Edgware Road, London. They were mostly familiar with Islamic banking since there is already established Islamic bank in the area. The first branch of The Islamic Bank of Britain was in this area. It was also found out that a good portion non-Muslims are aware about the features of Islamic banking. A number of these non-Muslim respondents were also found to be employees of Islamic banks. The fact that Islamic Bank of Britain employs the best person for the job regardless of color, creed, gender, and ethnicity, the system makes it more familiar to non-Muslims. It may be concluded that although Islamic banking is a good alternative to the conventional banking system, it should not replace the conventional system. The benefits drawn in the adoption of Islamic banking may be a very good alternative for investors who could use either or both systems to maximize the outcome of their investment plans. Chapter 1 Introduction 1. 1 Introduction What is Islamic Banking? Islamic Baking is quite a different system compared to a conventional banking system. The Islamic banking system prohibit usury and interest categorized as riba. It is governed by Shariah where Islam does not distinguish interest and usury (Haron 1995, p. 26). Currently, there are more than 150 interest-free institutions all over the world according to the International Association of Islamic Banks. Islamic banks nowadays were also serving non-Muslim countries such as Denmark, Switzerland and other Western countries. No interest is paid nor charged in an Islamic Bank. (Haron 1995, p. 26). The pioneer Mit Ghamr Local Savings Banks was established in 1963, somewhere in Nile Delta, Egypt, a provincial rural center. Although most of the banks operate in Muslim countries, it was also extended to the Western world. An example is the Islamic Banking System International Holding which was established in Luxembourg in 1978. It is considered as the first Islamic bank in the Western soil. The establishments of these banks were followed by other Islamic banks not only serving Muslim customers but also those who expanded their operations to service non-Muslims (Haron 1995, p. 27). After more than a decade since its establishment, it was estimated that over US$20 billion to US$40 billon of assets existed in the Islamic banking system worldwide. Currently, they have grown for more than US$60 billion. A study shows that the adoption of Islamic Banking in a financial system has not led to collapse as some feared to happen (Ghannadian & Goswami 2004, p. 242). Islamic banking is also playing a very important role in resource allocation, mobilization and utilization. It means Islamic banks are also providing savings to depositors and credits to the needy. Normal deposits such as savings account, current account and investment deposits are very available to customers. Islamic banks provide financial assistance in a short or long term business and individuals. They are also involved in international trade activities (Haron 1995, p. 27). 1. 2 Research Background It is difficult to pinpoint when Islamic banking started, but consensus suggests that it took place in Egypt in the 1960’s. In the mid 1970’s, Islamic banking started to take root in other Muslim countries. The changes were explained into main factors. First, the 1970s have seen oil price shocks which led to a massive transfer of wealth for the oil-consuming to oil-producing countries. Second is the fact that the oil shock coincided with the Iranian revolution which brought about the Khomeini government and the first Islamic republic (Akacem & Gilliam 2002, p. 126). By 2003, there were about 176 Islamic banks around the world, handling over US$ 147 billion and 32 banks are in an Arab state (Info Prod Research, 2003). This form of specialized banking may help to promote growth in the developing countries (Ghannadian & Goswami 2004, p. 242). As recent as 2003, there have been news about the introduction of Islamic hedge funds which could tap into the capital of Islamic families that could be worth a trillion dollars in asset management. According to banking statistics, the growth rate of Islamic banking has outpaced the growth of traditional banking in the past decade. Transformation Oriented Developing Economies (TODEs) made the transformation of society into full pledged market based economies (MBEs) a centerpiece in overall strategies. Many structural changes are required in its financial institutions, especially that the role of a financial intermediary in supplying funds to a growing new industry is crucial. Moreover, there are times when improper resource allocation may potentially result destabilization due to either faulty risk assessments. Or because of the design of its contract could be significant in examining the implementation of an Islamic banking system and how Islamic banks can provide liquidity and aid in creating money. This is through offering transactions accounts with compensation for inflation to risk-avoiding depositors (Ghannadian & Goswami 2004, p. 242). Evolution of Islamic The first modern experiment with Islamic banking was undertaken in Egypt. The pioneering effort of projecting Islamic image was led by Ahmad El Najjar who aimed to establish a savings bank based on profit-sharing in the town of Mit Ghamr in 1963. This experiment lasted until 1967, and by that time there were nine banks operating in the country. These banks neither charged nor paid interest and invested mostly in trade and industry directly or in forms of partnership and shared their profit with the depositors. This function is essentially a savings investment institution rather than a commercial bank. The Nasir Social Bank was established in 1971, IDB established in 1974 by the Organization of Islamic countries, and was the primarily inter-governmental bank aimed at providing funds for development projects in member countries (Sohrab 1996, p. 287). In considering the adoption of Islamic banking by conventional banks, what kind of benefits may be drawn from such adoption and the challenges they are going to face in undertaking such? Most benefits that may be drawn from the adoption of Islamic banking by conventional banks come from the features of its equity financing contract. With Mudaraba (trustee financing) and Musharaka (equity participation), entrepreneurs with little means and substantial collateral are able to gain access to capital (Sohrab 1996, p. 288). In addition, few businesses are able to operate strictly on cash basis without taking on debt or selling a portion of the business just to cover shortfalls or when there is a need for expansion (Bartlett & Economy 2002, p. 184). Because of this, it will be more attractive to engage into Islamic bank equity financing than that of conventional banks offering debt financing thus, making Islamic banking more competitive with regards to innovative entrepreneurial customers.
